Yes, you should threaten them. However, you should have stated that clearly on your webpage to begin with. Otherwise, it's all free content. Be more careful next time.

minimallwario, the unforunate issue is that you havent stated where and how the wallpapers are to be used either personally or commerically. For DigitalBox, they would have assumed those wallpapers you have made to be free of use in any form. Its very unforunate that they have taken your wallpaper but you cant really do anything in the legal perspective. However, if you can email them and talk to them, hopefully, they can be happy to take it off and use something of theirs. Things you need to consider:
1) Place (c) 2004 by minimallwario in small print somewhere inside each of your work, just to let people know its yours without destroying the overall art.
2) In the Downloads section, mention alongside the download (e.g. left side of your download page) "Disclaimer: these wallpapers are to be used soley for personal purposes and not be be used commerically in any form". Something like that.
3) The splash page you have put: "MWgraphics.it all rights reserved". Not clear it enough. Put: "Copyright (c) 2004. MWGraphics. All Rights Reserved." You can even further put something like "All work in this site are created by minimallwario and cannot be reproduced."
edit: About Digitalbox, the rotating cube bounce is cheesy. I think its here on Kirupa somewhere, in the Lab?

Thinking that you can use his work agrigo is puerile and sophomoric. His work is copyrighted by default and there for he holds the rights to it regardless of the fact that it is available for download.
I suggest removing that picture from your site immediately. Your argument will indubitably loose in a court of law. I advise a sincere apology to minimalwarrio.

Your attitudes certainly do not reflect your company as a representative and responding so unprofessionally. From what I see at your website, you certainly show some credentials and work. But I find it hard to believe that you didnt steal his graphic. Keep in mind even though he did not state how the images were to be used whether corporate or personal, its classified as intellectual property. On his side, it is his fault for not clarifying clearly enough for its usuage but it isnt his fault that you ignored the fact you should have asked permission to use. Isnt it a basic rule or concept that when you want to borrow things of another person, that you ask permission? If not, don't be saying you didnt steal his graphic.

Its called protecting your own work under International Copyright Laws so people will not try and manipulate and steal indivduals work.

Let me be clear about this situation as much as I can. Your question about my applications. My Macromedia Flash MX application was retail purchased, my Adobe Photoshop is retail purchased, my Windows XP was not purchased because HP preinstalls it on the system and I dont have Corel Draw. I do not see why you have asked these questions which has nothing to do with Minimalwarrio's graphic. Lets assume that Minimalwarrio is using an illegal version of Adobe Photoshop or whatever application he uses. What does that have anything to do with you stealing his graphic? If he using illegal software to create these graphics, that is not us to judge or the forum to deal with. If he is using illegal software, that is his own problem to deal with if he is question by Adobe or other representatives. I also do not think he can be stupid enough not to buy retail packages if he was to be a freelance designer working for corporate agencies or clients. Dont disfigure my vision or anyone elses vision offcourse about his graphic work. You may argue to any level or height but the underlining issue is you have clearly used his graphic in the Downloads section. I can see Minimalwarrio's fault for not stating a disclaimer but you should have atleast emailed him to see what he thinks. If you say what you are here:

geez.... this is so stupid.... digitalbox.... i would think that you would want to be original, certain things get gleaned from the web using google image search all the time... and thats ok. But i can't see how i would take a show piece from a graphic artist and put it on my site. i can't concieve that i could ever do that... if i am not creative enough to make my own wallpaper... i don't need to be in this business.
