regarding sprites

Im making a 2d tile game an was wondering if I could use sprites from some nintendo classic sprites. Im actually thinking of remaking a classic, but im still deciding.

I know you mentioned you can remake a game. All the code is mine, but it looks cooler when people can recocnise the characters/sprites

Is it legal to use them or illigal?

I'm going to guess that it is legal as long as you don't try to resell your game. I am not entirely sure, but I have seen a great deal of Flash game tutorial sites and Flash games using old NES sprites. I have not heard of any major crackdowns on sites using NES sprites :)
