hi i'm following this tutorial
http://robouk.mchost.com/tuts/tutorial.php?tutorial=lcdorbs
part 2 : Now without deselecting, create a new layer:
Press X, then D on the keyboard to reset the colours. Now go to Edit>Stroke for the settings choose 4 and colour black. Click OK.
I have the path in layer1 selected then create a new layer, then try to stroke it.. but obviously it doesn't work since there is nothing in that layer to stroke.. surely it doesn't mean stroke layer 1 does it?

It means stroke the selection :)
you can also, while having the marquee tool selected, and your current selection still on, rightclick within the selectiona dn go "stroke"
:)

"Now without deselecting, create a new layer: "

When you create a new layer it should be blank and you should retain the selection you had from the previous layer.

yep true, this iswhat i do, I use the path selection tool in layer 1 and select the path, then i click the create layer button (now the new layer is selected in the layers panel but the selection is still in tact), then i go edit>stroke but then it says the layer is empty ??? hmm

Path selection tool? No, you're doing something wrong there's no path there, only a selection.
Better start with a new file and follow the tutorial step by step.
