Plagiarism is claiming someone elses work as your own, using the idea and then recreating it yourself (ie: taking the idea of the stars in the streaked purple sky BUT THEN creating your own graphics) would probably be fine We used space invaders characters once on a website for a gaming community, they got sued BIG TIME by japan, it's a big deal man, it could cost kirupa more than just the prize money.

This wouldn't fly with Apple. The Adobe one would because it's not the official Adobe background. You, though, just took the Apple background and added it directly.
