I'm having trouble getting an emptymovieclip which i have created to draw with to appear below the top layer. . . is LineTo always at the top depth????

i've been able to do this in flash 5 with the kirupa flash 5 draw tutorial but i can't load xml in flash 5... could someone please confirm if LineTo() is always on the top layer????
