In photoshop:
1.Find a photo of a tree
2.Adjust the curves so all you have is a black and white tree
3.Create a layer beneath the tree and place a gradient color of your choice
4.change the layer style of the tree to multiply.
That's it.

fly to england, find a nice tree and wait till dawn to take a nice gloomy picture (it goes without saying that the place will be foggy).
What sir vroeg said, anyway.

in Illustrator, just paste an image of the tree you like and use the pen tool to outline it. Once you've finished the outline, give it a black fill and remove the stroke. you can use photoshop to render a gloomy cloudy background (render clouds or render cloud difference) play with your filters and effects.

Filter>Cutout
